New ELD Requirements
After several failed attempts, the Federal Motor Carrier Safety Administration (FMCSA) has finalized and published the Final Rule requiring the use of electronic logging devices (ELD) by commercial vehicle operators to document hours-of-service (HOS). Aimed at improving roadway safety, this rule requires the implementation of technology to strengthen driver compliance with HOS regulations. The goal is to prevent driver fatigue.
In the past, on and off duty logs have been recorded using pencil and paper, making them nearly impossible to verify. This opens up the possibility for fraud, workers overcharging for gas reimbursement as well as drivers working more hours than allowed by law. U.S. Transportation Secretary Anthony Foxx says in a statement, “This automated technology [ELDs] not only brings logging records into the modern age, it also allows roadside safety inspectors to unmask violations of federal law that put lives at risk.”
In 2 years, the use of ELDs will be required by all commercial vehicles. Companies have a two year grace period to implement ELDs to their business, but according to FleetOwner, “if a carrier installs a compliant advanced onboard recording device (AOBRD) prior to the compliance date, it will have the option to continue using that device for an additional two years beyond the compliance date.”
With the implementation of this ELD Final Rule, an estimated net benefit of more than $1 billion will result from this rule, mainly due to the reduced amount of required industry paperwork. With this Final Rule, not only will there be an increased efficiency when roadside law enforcement reviews driver records, but commercial drivers will also be protected from harassment as well.
